Kim Davis, an elected County clerk in Kentucky, USA, who issues marriage licences as part of her job, refused to hand out licences for homosexual ‘marriages’ because of her Christian faith (and the LAW of Kentucky). This has been a targeted campaign by homosexuals. Watch the video at the ABC (USA) link below – where she is confronted by homosexuals PLUS the media… After same-sex marriage was ‘legalized’ nationwide in the USA in late June by the Supreme Court, Kim Davis filed a suit in federal court, arguing that she should be excused from issuing marriage licenses to same-sex couples on the basis of her "Christian faith." She then refused to hand out marriage licenses to anyone. A District Court and the Sixth Circuit Court of Appeals ruled against her and ordered her to issue marriage licenses. She then appealed to the US Supreme Court for a ‘stay’ but the “US Supreme Court refused Davis' request for a stay, which was a request to put the lower court's ruling on hold pending appeal.” When she continued to refuse to hand out ‘marriage’ licences to homosexual couples, Kim Davis was sent to jail for ‘contempt of court’ on 2 September. As she was led away, a crowd chanted ‘Love wins’! Appeal lodged On 6 September, Kim and her lawyers lodged an appeal against the contempt order (Liberty Counsel report). Yesterday (7 September) her lawyers lodged an “emergency request for the Governor to accommodate Kim’s religious conviction, which would free her from jail” (LC report). What LAW? Importantly, Kim Davis is asking the question, “Under what law am I authorized to issue homosexual couples a marriage license?” As Mike Huckabee states, “The Supreme Court cannot and did not make a law. They only made a ruling on a law. Congress makes the laws. Because Congress has made no law allowing for same-sex marriage, Kim does not have the Constitutional authority to issue a marriage license to homosexual couples.” Others have noted (see below) that the Constitution of Kentucky, under which she swore her Oath of Office, still states that marriage is between a man and a woman! Mike Huckabee, former Arkansas Governor, Baptist pastor and Republican presidential candidate, plans to visit Kim at the Carter County Detention Center this week, and will host a rally in her honour after meeting her. Mike said, “Having Kim Davis in federal custody removes all doubt of the criminalization of Christianity in our country,” and added, “What a world, where Hillary Clinton isn’t in jail but Kim Davis is!” Hillary Clinton OPPOSES Kim’s actions Hillary Clinton distributed an article about the jailing of Kim Davis and tweeted, “Marriage equality is the law of the land. Officials should be held to their duty to uphold the law—end of story.” (source) The LAW of Kentucky – marriage between a man and a woman One commentator notes that Kim Davis swore an oath to uphold the law of Kentucky – and the Kentucky Constitution STILL says that marriage is between a man and a woman – and that anyone marrying any OTHERS apart from a man and a woman commits a misdemeanour and is liable to a fine and removal from office! (See comment and the law here). The commentator claims that SCOTUS doesn’t override that and that the people of Kentucky have to vote to change the Constitution – interesting point!
